Please read these terms before using the site or submitting an order. By doing so, you agree to these terms and the policies linked from them. If you do not agree, do not use the services.
1. Eligibility and agreement
You must be at least 18 years old and able to enter a binding contract to place an order. If you act for another person, you represent that you are authorized to provide their information and make decisions for the requested service.
Visionne may update these terms prospectively. The version in effect when we accept an order generally governs that order unless law requires otherwise.
2. Services and site information
Visionne offers retail eyewear, contact lenses, custom lens replacement, order support, and access to certain prescription-related workflows. Product images, colors, lens previews, measurements, timing, and availability are illustrative or estimated unless expressly confirmed in writing.
We may correct errors, update content, limit quantities, suspend features, or discontinue products. Availability varies by prescription, frame, supplier, location, and law.
3. Order requests, acceptance, and pricing
Submitting the online lens form creates an order request, not an accepted order. Displayed totals are estimates. We inspect the frame and review prescription and production requirements before confirming scope, final price, and acceptance.
- We may request more information, propose a different lens, or decline work that is unsafe, unavailable, or incompatible.
- Taxes, optional upgrades, carrier charges, and approved changes may affect the final amount.
- An order is accepted only when Visionne provides written confirmation or a final invoice.
- Payment terms shown on the invoice or payment page apply to the transaction.
4. Prescriptions and customer information
You are responsible for submitting accurate, complete, current information. Prescription products require a valid prescription from an authorized prescriber unless applicable law allows another process. We may verify a prescription, request pupillary distance or fitting information, and pause or cancel an order if information is incomplete, expired, or inconsistent.
Do not use this website for urgent symptoms, injury, sudden vision changes, flashes, severe pain, or other emergencies. Seek appropriate in-person medical care.
5. Frames sent to Visionne
You confirm that you own or are authorized to send each frame. Used, vintage, rimless, drilled, damaged, brittle, altered, or previously repaired frames can fail during inspection, lens removal, production, adjustment, or transit even when reasonable care is used.
We may decline a frame before production. If we identify elevated risk and offer to continue, we may require your written approval. Nothing in these terms limits responsibility that cannot be limited by law.
6. Shipping, cancellations, returns, and remakes
Mail-in and outbound shipments are governed by our Shipping Policy. Cancellations, product returns, manufacturing concerns, and custom-lens remakes are governed by our Returns and Remakes Policy. Custom products may not be eligible for discretionary return after production starts.
7. Licensed providers
Visionne is not an eye-exam practice. When a licensed provider reviews renewal eligibility or provides a clinical service, that provider exercises independent professional judgment and may apply separate consent, fee, telehealth, and privacy terms. See Provider Relationships.
8. Acceptable use and intellectual property
You may use the site only for lawful personal or business purposes consistent with these terms. You may not interfere with security, misuse forms, introduce malicious code, scrape the site at unreasonable volume, impersonate another person, or use content in a way that infringes rights.
Visionne names, logos, site design, text, graphics, software, and original media are owned by Visionne or its licensors and protected by applicable law. Limited personal use of the site does not transfer ownership.
9. Disclaimers
To the fullest extent permitted by law, the website is provided on an "as available" basis. We do not guarantee uninterrupted access, error-free content, exact screen-to-product color matching, or that every frame or prescription can be fulfilled.
Any written product warranty or remake commitment applies according to its stated terms. These terms do not exclude warranties or consumer rights that cannot legally be excluded.
10. Limitation of liability
To the fullest extent permitted by law, Visionne will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website or services. Visionne's aggregate liability for a claim relating to a specific order will not exceed the amount paid for that order, except where a different limit is required by law.
These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury caused by negligence, or any liability that cannot be limited under applicable law.
11. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Before filing a claim, please contact us and allow a reasonable opportunity to resolve it. Unless applicable consumer law permits another forum, disputes may be brought in the state or federal courts located in New York County, New York.
If part of these terms is unenforceable, the remaining terms remain in effect. Failure to enforce a term is not a waiver. You may not assign your rights under these terms without our consent; Visionne may assign them as part of a merger, financing, reorganization, or transfer of the business.
